What the document contains

1. To whom: the court, by its official name
2. The claimant (name, passport data, registered and notification address, phone, e-mail; for a company the name, state registration number and address), the representative if any, the respondent and other participants
3. The price of the claim, since the claim is for money
4. The facts: the contract or receipt (date, amount, term of return), what was paid back, and the delay
5. The calculation: principal, interest for the use of money, and penalty if the contract sets it, each with the period and formula
6. The claims as an ordered list, against each respondent separately when they are not jointly liable
7. The list of attached documents, the date and the signature of the claimant or the representative

What to know before signing

• A claim must contain the court, the claimant with passport data and addresses, the representative’s data, the respondent with a registered address, other participants, the facts, for money claims the amount and its calculation, the claims against each respondent, and the list of attached documents and evidence.
• The claim is signed by the claimant or the representative.
• The court decides within seven days whether to accept, return or refuse the claim, and a claim with missing items is returned.
• The amount of the state duty is not stated unless the person gives it, because rates change; the text only refers to the receipt of its payment.
• Interest for late payment is calculated on the Central Bank refinancing rate unless the contract says otherwise; numbers are never invented, and placeholders stand for what the person did not give.

What to attach

• A copy of the claimant’s identity document
• The receipt of the state duty
• Proof that copies of the claim and attachments were sent to the other participants
• The representative’s authority and a copy of the identity document, when there is a representative
• A loan contract or receipt
• The demand letter, if one was sent, and proof of sending
